That City Council adopt Resolution No. 17-19 opposing State Legislation that would preempt local regulations.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PENSACOLA, FLORIDA, OPPOSING ANY AND ALL STATE LEGISLATION THAT WOULD PREEMPT LOCAL REGULATIONS TO THE STATE BY PROHIBITING LOCAL GOVERNMENTS FROM IMPOSING OR ADOPTING CERTAIN ORDINANCES, REGULATIONS, RULES, LICENSES, PERMIT OR OTHER REQUIREMENTS, INCLUDING ASSOCIATED FEES; OPPOSING ANY AND ALL STATE LEGISLATION THAT WOULD PREEMPT AND REPEAL BY OPERATION OF STATE LAW ANY EXISTING LOCAL REGULATIONS; OPPOSING ANY STATE LEGISLATION THAT WOULD LIMIT LOCAL GOVERNMENTS IN MODIFYING OR IMPOSING ADDITIONAL REGULATIONS; AND PROVIDING FOR AN EFFECTIVE DATE

SUMMARY:
During the 2017 Legislative Session, there are certain pieces of legislation whose end result, if passed, would preempt local government from self-regulating, to include imposing or adopting certain ordinances, regulations, rules, licenses, permits or other requirements, including associated fees. Some of these pieces of legislation would preempt and repeal by operation of state law, existing local regulations and limit local governments in modifying or imposing additional regulations.
This resolution expresses the City Council’s opposition to any piece of legislation whose intent or end result is that of preempting local government’s ability to govern.
