That City Council approve an Interlocal Agreement with Escambia County, Florida for the adoption, administration, and enforcement of airport zoning regulations in accordance with the requirements of Florida Statute 333.03(1)(b)(1). Further that City Council authorize the Mayor to take any and all actions necessary to execute the Interlocal Agreement.

SUMMARY:
The Pensacola International Airport has contracted with the West Florida Regional Planning Council to conduct a consistency review for the City of Pensacola based on recent changes to Florida Statute 333 - Airport Zoning. The Florida Statute requires that the City’s Land Development Code be consistent with F.S. Chapter 333.
Proposed amendments to the City’s Land Development Code have been presented for consideration to allow the City to remain in compliance with changed Florida Statutes, and similar amendments for County Ordinances are being presented to the Escambia County Board of County Commissioners. In addition to the changes to the Land Development Code, Florida Statute also requires that in those locations where the airport hazard area in which obstructions could be constructed in such a manner so as to affect the safe operation of aircraft falls into multiple political subdivisions, then those political subdivisions shall either have an Interlocal Agreement to adopt, administer, and enforce a set of airport protection zoning regulations, or have a joint airport zoning board. Staff with the City of Pensacola and Staff with Escambia County have determined that the requirements of the Florida Statutes can best be met through an Interlocal Agreement.
PRIOR ACTION:
May 11, 2017 - City Council conducted a Public Hearing to consider the proposed amendment to the Land Development Code pertaining to Airport Protection Regulations.
May 11, 2017- City Council approved Proposed Ordinance No. 14-17 - Amending Chapter 12-2 Airport Land Use District; Chapter 12-11 Airport and Chapter 12-14 Definitions on first reading.
