RECOMMENDATION:

That City Council Amend City Council Policy 4.36 - Public Input by removing the following language:
In all circumstances where appropriate, the Chair of the meeting shall allow the public the last opportunity to speak to an issue.
And replace it with:
In all circumstances, where appropriate, the Chair of a meeting shall ensure that the public has had an opportunity to speak to an issue prior to formal action being taken.
Further, that City Council direct the Council Executive to ensure that each Council created Board has within its rules and procedures a section covering Public Input, with pre-approved language.

SUMMARY:
Due to a recent occurrence, the issue of the public’s ability to provide input on agenda items at Board meetings has come into question.
At the December 13, 2018 City Council meeting, City Council approved a legislative action item which stated that, “City Council would mandate its boards and commissions to solicit public input and participation in meetings before board action is taken.”
This amendment to Council Policy 4.36, along with ensuring board rules and procedures reflect this action, will help to ensure that the public has the opportunity to be heard, while still ensuring that those seeking board action as well as the boards maintain their proper position and role.
PRIOR ACTION:
December 13, 2018 - City Council approved action item No. 18-00461 - mandating the public’s opportunity to be heard at board and commission meetings.
January 10, 2011 - City Council policies became effective under the new form of government via Resolution 24-11.
