That City Council adopt Resolution No. 2021-52:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PENSACOLA AUTHORIZING THE CITY TO JOIN WITH THE STATE OF FLORIDA AND OTHER LOCAL GOVERNMENTAL UNITS AS A PARTICIPANT IN THE FLORIDA MEMORANDUM OF UNDERSTANDING AND FORMAL AGREEMENTS IMPLEMENTING A UNIFIED PLAN CONCERNING THE NATIONAL OPIOID LITIGATION; PROVIDING FOR AN EFFECTIVE DATE.
Further, that the City Council authorize the Mayor to execute the Florida Memorandum of Understanding and any additional agreements and documents necessary to implement the unified plan for the allocation and use of opioid settlement proceeds that are not substantially in consistent with the Florida Memorandum of Understanding.

SUMMARY:
The State of Florida has filed an action pending in Pasco County, Florida, and a number of Florida cities and counties have also filed an action In re: National Prescription Opiate Litigation, MDL No. 2804 (N.D. Ohio). The City is a litigating participant in that action.
The State of Florida and lawyers representing certain various local governments involved in the opioid litigation have proposed a unified plan for the allocation and use of prospective settlement dollars from opioid-related litigation. The Florida Memorandum of Understanding sets forth a framework for said unified plan. The city’s attorneys recommend that the city participate in the unified plan.
PRIOR ACTION:
June 30, 2021 - City Council conducted a Shade Meeting with their City Attorney and Outside Council to be briefed on the Opioid Settlement.
March 12, 2018 - The City filed a complaint in the MDL litigation.

FINANCIAL IMPACT:
If the State of Florida settles its lawsuit in the opioid litigation and the city participates in the unified plan for the allocation and use of opioid settlement proceeds, then the city can anticipate receiving settlement funds for 7+ years for authorized uses to address societal ills created by the opioid epidemic. The precise amounts that would be received are uncertain at this time
