That City Council refer to the Planning Board a proposed repeal of Section 12-3-65 - Parking for certain uses prohibited - of the Land Development Code.

SUMMARY:

 

Section 12-11-3 - Amendments -of the Land Development Code states in part:

 

                     The city council may, from time to time on its own motion, or on petition, or on recommendation of the planning board or the zoning board of adjustment or any department or agency of the city, amend, supplement, or repeal the regulations and provisions of this title and the comprehensive plan.

 

                     (1)(a) - Every such proposed amendment or change, whether initiated by the city council or by petition, shall be referred to the planning board who shall study such proposals and made recommendation to the city council.

 

Therefore, any requested amendment, including a repeal must be sent to the planning board prior to Council taking action.

 

Currently within city code, there are two (2) duplicative sections; 11-2-24 and 12-3-65 - Parking for certain uses prohibited.

 

This action would refer to the planning board a proposed repeal of Section 12-3-65 of the Land Development Code - Parking for certain uses prohibited.

February 9, 2006 - City Council amended Section 12-3-65 (at the time listed as Section 12-2-42) of the City Code via Ordinance No. 04-06
