That City Council approve the Lease Agreement between the City of Pensacola and Pensacola Federation of Garden Clubs Inc. for the Garden Center located at 1850 North 9th Avenue.  Further, that City Council authorize the Mayor to take all necessary actions to execute and administer the Lease Agreement.

SUMMARY:

                                          

The Pensacola Federation of Garden Clubs is a not-for-profit corporation dedicated to promoting civic beauty and advancing the fine art of gardening and horticultural study for the benefit of the general public.  In April 1961, the City Council adopted a Resolution authorizing the lease of a portion of Greenwood Park (the City-owned real property now addressed as 1850 North 9th Avenue) with the Pensacola Federation of Garden Clubs for the construction of their headquarters, the Garden Center.  The Resolution specified a 30-year lease with renewal option included for $1.00 per year with reversion to the City upon expiration.

 

The Garden Center is currently used as an event space and as the administrative headquarters of the Pensacola Federation of Garden Clubs.  The 1961 lease and renewal expired on December 31, 2020, unbeknownst to the City and the Pensacola Federation of Garden Clubs until early 2021. A new lease for the Garden Center is desirable by both the City and the Pensacola Federation of Garden Clubs. Due to the effects of the COVID-19 pandemic to their operations and the repairs resulting from Hurricane Sally, delays have been experienced in working out the particulars until present.

 

The lease has been modernized with updated language, though it remains a triple net lease, with all operational expenses the responsibility of the lessee and improvements reverting to the lessor upon lease expiration.  In an attempt to prevent any future outages, the term has been reduced to 10 years with two 10-year renewal options, and the Pensacola Federation of Garden Clubs must submit their commitment to continuation every two years, coinciding with their group’s election of their new president.

April 27, 1961 - City Council adopted Resolution 13-61, authorizing the lease of the land to the Pensacola Federation of Garden Clubs Inc., upon which the group would construct the Garden Center and subsequent addition
